It is emphasized that you do not disregard professional psychological or medical advice or delay in seeking it simply because of the services provided by the Website.

By using the Website, you accept these terms and conditions in full and without reservation.

The term “you” refers to the user or viewer of the website. The tern “we” refers to the Website. While we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, completeness availability or suitability with respect to the Website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

At times clients and other third parties (e.g. other professionals) will post their comments on the Website sharing the respective reviews. The Website does not represent these viewpoints and therefore the Website does not take responsibility of you acting according to these reviews.

The information contained in or made available through the website and in the associated products, and services, including but not limited to information contained on the Website blogs, vlogs, videos, books, comment section, and other written or audio-visual materials, as well as information imparted during individual coaching sessions, cannot replace or substitute for the services of trained and licensed professionals in any field, including, but not limited to: financial, medical, chiropractic, psychological, or legal matters.

By accessing the Website and/or using our products and services such as individual coaching, you affirm and acknowledge that life coaching, mindset coaching and/or small business coaching are not forms of or substitutes for counselling, psychotherapy, mental health care or other medical or health care intervention of any kind.

If you are currently under the care of a medical or mental health professional, it is your responsibility to consult with that person regarding the advisability of working with a coach. If at any time you feel the need for professional counselling, you agree to promptly seek the assistance of a licensed professional.

In addition, participating in coaching may entail risks associated with a challenging program of personal growth and development, including risks of mental or emotional upset, as well as risks that may not be foreseeable when you begin a coaching engagement. By participating in coaching, you freely and voluntarily assume all such risks and you acknowledge and agree that you are responsible and accountable for your decisions, actions and results in life, and you agree not to attempt to hold the Website, Erica Harris and any person and company associated with the Website and Erica Harris liable for any such decisions, actions or results, at any time, under any circumstance in perpetuity.

Erica Harris and this Website are not claiming to, nor do they provide any professional help of any kind including but not limited to legal, medical, educational, or chiropractic services etc. as it would be inaccurate and unlawful to do so.

Any advice, services or tools provided are suggestions only with no guarantees of any particular or specific outcome. You are responsible for your actions and their corresponding results. All statements on the Website are for occasional entertainment purposes and are always opinions only, not guarantees that you will achieve any particular or specific result. Results will vary by individual.

Throughout the Website, you can be connected to links of other websites. We do not have control over the nature, content and availability of those sites. Additionally, the inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

You are responsible for your actions, behaviour and resulting outcomes. You must not utilize the Website to copy, publish, or send any information.

All information and material you submit to our website in the form of a comment (or post) including information you copy or send to or from the Website must not be defamatory, obscene, indecent, hateful, discriminatory or inflammatory; such material must not infringe any person’s intellectual property rights or rights of confidence, impinge upon any person’s privacy, or constitute incitement to commit a crime; further, material must not be misleading, deceptive, pornographic, threatening, abusive, harassing or menacing.

No waiver of any term contained herein, whether by conduct or otherwise, shall be effective except in a writing signed by the party to be charged with the waiver. If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining terms shall remain in full force and effect, and such invalid or unenforceable provisions or portion thereof shall be deemed omitted.

COACHING

CANCELLATION/ NO SHOW POLICY

We understand that there are times when you must miss an appointment due to unforeseen circumstances, family situations, emergencies or other obligations. If you need to reschedule, please use the rescheduling link in your confirmation email to cancel or reschedule with 24 hours’ notice. If you have an emergency (illness or accident) we’ll work around it. A full cancellation fee will apply for sessions cancelled with less than 24 hours’ notice for a non-emergency reason.

PAYMENT

Sessions are not confirmed until they are paid for. All sessions must be paid for before the beginning of the session. The Cancellation/ No Show Policy applies to all sessions.

REFUNDS AND CREDITS

If the client is unsatisfied with the services provided by the coach then a full refund will be issued if requested in writing within 24 hours of the session. If a plan is purchased any unused sessions can be refunded subject to the Cancellation/ No Show Policy.

CONFIDENTIALITY

For private coaching sessions, the coach agrees to keep all conversations and information with the client private and strictly confidential. No personal ideas, information or thoughts expressed by the client will be shared with anyone except with the express written permission of the client. The coach will not disclose the client’s name as a reference without the client’s express written consent.

Confidential information does not include information that:

(a) was already in the coach’s possession;

(b) is generally known to the public or in the client’s industry;

MISCELLANEOUS

These Terms and the Privacy Policy represent the complete and entire agreement between us concerning your use and access of the Website. These Terms precede all prior or contemporaneous agreements, negotiations or understandings, whether oral or written.

These terms will be governed by and interpreted per the laws of British Columbia, Canada without reference to any conflict of laws provisions. Any action relating to the use of the Website and its services must be brought in the province of British Columbia, Canada and the parties hereby submit to the exclusive personal jurisdiction and venue of such courts. You may not assign, charge, sub-contract or otherwise transfer your rights or obligations under these terms, and any attempt by you to do so shall be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising hereunder at any time. No waiver of any term contained herein, whether by conduct or otherwise, shall be effective except in a writing signed by the party to be charged with the waiver.

SEVERANCE

If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining terms shall remain in full force and effect, and such invalid or unenforceable provisions or portion thereof shall be deemed omitted.
